Due to the entry into force on May 25, 2018 of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95 /46/EC (referred to as “GDPR”, “ORODO”, “GDPR” or “General Data Protection Regulation”), we would like to inform you that Śląskie Centrum Logistyki S.A. makes every effort to protect your personal data as best as possible.

 

Fulfilling our information obligation under the GDPR, we want to inform you how we process personal data and, above all, inform you about the rights arising from the regulations that will be available to people who have entrusted us with their personal data.

 

The administrator of personal data is Śląskie Centrum Logistyki S.A. based in Gliwice (44-100) at ul. Portowa 28.

 

The personal data administrator processes personal data pursuant to Article 6(1) of the GDPR. Natural persons whose data are processed by ŚCL S.A. have the right to access their data and request its correction, supplementation, rectification, transfer, forgetting or limitation of processing, and also the right to object to their processing. Śląskie Centrum Logistyki S.A. does not process personal data in an automated manner and does not profile this data, except for profiling on behalf of companies cooperating as a processor.

 

Purpose, scope and legal basis for personal data processing at ŚCL S.A

 

  1. What data are we talking about?

This is personal data that is collected as part of your use of our services, i.e. websites, correspondence sent by phone or via e-mail, websites and other functionalities provided by Śląskie Centrum Logistyki S.A., including those saved in cookies that are installed on our websites by us and our trusted Partners.

  1. Purpose of data processing

Your personal data is processed for the purposes described in our policy, including:

 

  • match the content of the websites and their topics, including the topics of the materials appearing there, to your interests,
  • ensure greater security of services, including to detect possible bots, fraud or abuse,
  • show news tailored to your needs and interests,
  • enable you to contact the website Administrator (www.scl.com.pl) via the contact form,
  • provide you with support on the website via live chat (smartsupp.com) by answering your questions or solving your problems

 

  1. Who can we transfer data to?

We may transfer your data to entities authorized to obtain data under applicable law, e.g. courts or law enforcement authorities – of course, only if they make a request based on an appropriate legal basis.

 

  1. What are the legal bases for processing your data?

Any processing of your data must be based on an appropriate legal basis in accordance with applicable regulations. The legal basis for data processing for the provision of services is in accordance with Art. 6(1)(a) b) GDPR, necessity to perform contracts (these contracts are usually regulations or similar documents available in the services you use). Pursuant to Article 6(1)(a) f) processing is necessary for the purposes of the legitimate interests pursued by the administrator. Processing for the purposes of adapting the content of services to your interests, ensuring security, statistical measurements, improving services, as well as for the administrator’s own marketing purposes. The processing of your data for marketing purposes will be based on your voluntary consent. The administrator guarantees the confidentiality of all personal data provided to him. All pages on the Website are equipped with an SSL certificate, which enables secure data transmission. Personal data is collected with due care and adequately protected against access by unauthorized persons.

Personal data is collected in accordance with the principle of privacy by default (minimization of data needed to fulfill the purpose of processing) and transferred only to:

  • Smartsupp (live chat used) with headquarters 602 00 Brno Czech Republic (European Union) ul. Milady Horakove 13 – to support visitors via live chat on the website. Support provided to answer questions or solve problems. Details of data security are available at https://www.smartsupp.com/help/privacy/
  • Google (the tool used is Google Analytics) – to analyze website statistics. This entity guarantees the confidentiality of data stored in its databases. Data about users and events is anonymous. Data security details are available at https://privacy.google.com/businesses/processorterms/
  • Google (the tool used is You Tube) – to present instructional videos and other video materials. Due to the embedding of YouTube videos, when you watch them, Google collects data for your Google account and uses it to suggest other videos that might interest you. The website www.scl.com.pl uses only Google technology to display and share videos. It does not affect the settings of your Google account, so users decide themselves about the use of their data within Google services and tools.
  1. Information about individual personal databases:

Fulfilling the information obligation towards the owners of personal data, we would like to inform you that your personal data are processed by ŚCL S.A. in relation with:

 

  • with business cooperation or the supply/purchase of services and are processed within the scope of an economic contract pursuant to Art. 6 section 1 letter b) GDPR,
  • with the implementation of obligations arising from legal provisions (tax purposes, accounting, pursuing claims) pursuant to Art. 6 section 1 letter c) GDPR,
  • in connection with debt collection and legal services, data is processed on the basis of Art. 6 section 1 letter f) GDPR.

The scope of processed personal data results solely from legal provisions or internal regulations. Providing data for the purpose of cooperation is necessary to provide services and issue invoices. Failure to provide data makes it impossible to perform a specific economic event.

 

The data may not be transferred outside the European Economic Area where an adequate level of protection has not been established. In such a case, an appropriate technical method is used to secure this data at the time of transmission.

 

Recruitment

 

Fulfilling the information obligation towards persons participating in the recruitment process, we would like to inform you that your personal data is processed in connection with your participation in the recruitment process in order to carry out recruitment on the basis of applicable legal provisions, in particular on the basis of the Labor Code, Art. 6 section 1 letter c) GDPR and on the basis of the consent expressed in the scope of voluntarily provided data related to participation in recruitment – Art. 6 section 1 letter a) GDPR.

 

The recipient of your personal data may be entities providing and maintaining the Administrator’s IT infrastructure, providing recruitment services, as well as other entities only if they are authorized to do so under applicable law.

 

Providing personal data is voluntary, but necessary to carry out the recruitment process.

 

  1. Time of personal data processing

Personal data provided in the above-mentioned purposes will be stored as long as business relations are maintained and for the period necessary to meet accounting and tax obligations or pursue claims. For contained data

in commercial contracts, orders and other documentation related to cooperation

with the Administrator, this documentation is destroyed no sooner than 6 years after the end of cooperation, unless a request is submitted to the Administrator first.

In the case of recruitment, your personal data will be stored for the period of recruitment and then will be permanently deleted.

 

You have the right to request from the Administrator:

 

  • access to your personal data – you have the right
  • at any time request information about your personal data that the Administrator stores or has access to,
  • rectification – the Administrator takes reasonably justified steps to ensure that your personal data is correct, complete and up-to-date. This is a mutual responsibility, on both your and the Administrator’s part. If it is necessary to make changes to these data, you should notify the Administrator about it,
  • deletion, restriction of processing and transfer of data. In the cases indicated in the regulations, you have the right to request the deletion of your personal data (which applies in particular, but not exclusively, to situations when you raise an effective objection to the processing of your personal data and the Administrator does not have an overriding legitimate basis for processing or the processing is carried out for marketing purposes). This right will be exercised by the Administrator without undue delay and provided that other regulations do not impose an obligation on the Administrator to process data. You can also request the restriction of further data processing.

9.Cookies policy:

  1. Śląskie Centrum Logistyki S.A. (hereinafter referred to as the Administrator) automatically collects only information contained in cookies.

2.Cookies:

The term “cookie” used in this document refers to cookies and other similar tools described in Directive 2009/136/EC of the European Parliament concerning the processing of personal data and the protection of privacy in the electronic communications sector (Directive on privacy and electronic communications) and Art. 173 Telecommunications Law of July 16, 2004 (Journal of Laws No. 171, item 1800, as amended)

 

Cookies are small IT data files saved and stored on a computer, tablet or smartphone intended for the use of websites. “Cookies” usually contain the name of the website they come from, their storage time on the device and a unique number.

 

3.The administrator is an entity that places cookies on the user’s end device.

Possibility to determine the conditions for storing or accessing cookies. The User may independently change cookie settings at any time, specifying the conditions for storing them and accessing cookies to the User’s device. The User can change the settings referred to in the previous sentence using the web browser settings or via the service configuration. These settings can be changed in particular in such a way as to block the automatic handling of cookies in the web browser settings or to inform each time a cookie is placed on the User’s device. The user may delete cookies at any time using the available functions in the web browser he or she uses. Restricting the use of cookies may affect some of the functionalities available on the website.
